Question by : Do you think a jury would convict on Spyware Charges?
Curious on input. Husband and Wife going through divorce. She moves out. He enters her new home without permission. He puts spyware on computer. She has all evidence of snap shot, key logger and him purchasing it on a credit card. Evidence that Spyware program was mailed to him. There is a Spyware law and its illegal. I have heard that because they are still married it would be hard to convict. However, they had filed for divorce and set up new residence. What do you think?

I think that one sentence of your explanation would send him to prison for five or six years: “…He enters her new home without permission…”
That is the textbook definition of felony burglary.
